This vehicle has NOT been inspected. It is highly recommended that prospective bidders make an on-site visit to inspect the vehicle and best determine the condition of the equipment prior to bidding. The equipment is being sold “as-is, where-is” with absolutely no guarantee or warranty. No further repairs will be made to equipment.
LIABILITY: THE CITY OF ECORSE MAKES NO EXPRESS OR IMPLIED WARRANTIES IN CONNECTION WITH THIS ITEM(S), INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANT ABILITY OR FITNESS FOR A PARTICULAR PURPOSE
. The purchase of any item(s) is on an “as is” basis. This includes no warranty as to the quality, quantity, or condition of any item(s) or container(s). The purchaser takes the item(s) free of any entitlement to damages, recession, or any other remedy on account of the quality of any item purchased.
THE CITY OF ECORSE IS RELEASED OF ALL LIABILITY FOR ANY AND ALL DEFECTS. The Purchaser fully acknowledges and agrees that the Purchaser shall defend, indemnify and hold harmless the City of ECORSE, its employees, and agents against:
1) any damages, loss, theft, or destruction of any item(s) or contents of any item(s); and,
2) all liability, damages, claims, and demands, costs and expenses of every kind and nature, without regard to whether covered by insurance, arising out of or connected with the use, repair, maintenance, or operation of the item(s).
If you are unclear about any condition of this sale, contact the Purchasing Division for clarification at 313 590-1696. All sales will be final. There are no returns for any reason. In its sole discretion, the City may withdraw any item(s) from the auction at any time up to the close of the auction. The City of Ecorse assumes no liability for inaccurate or erroneous descriptions contained in any descriptive material pertaining to the auctioned item(s).
PAYMENT:
All items purchased must be paid in full prior to pick-up. Payment is to be made at the Police Department to Corporal Barkman: Office, 3869 W Jefferson Ave Ecorse MI 48229.
ALL PAYMENTS WILL BE MADE OUT TO THE CITY OF ECORSE
NO PERSONAL CHECKS, OUT-OF-STATE OR FOREIGN CHECKS WILL BE ACCEPTED.
At the time of payment, the successful bidder will be required to sign a disclaimer of warranty and liability and an acknowledgment of acceptance of the item(s).
If the successful bidder is another governmental entity including public schools, that entity’s check will be accepted for payment.
SALES TAX will not be added to this purchase. It is the responsibility of the buyer to pay sales tax at the Secretary of State.
PICK-UP:
Once the item(s) has been paid for, it can be picked up by the awarded bidder at the City of Ecorse, 3869 W. Jefferson Ave Ecorse MI 48229, Monday through Friday during normal business hours. The awarded bidder must bring the paid receipt to the City Hall when picking up any item(s). The City reserves the right to request identification from the person picking up the item(s).
All items will be removed at the risk and expense of the purchaser. The purchaser agrees to provide all labor, materials, and equipment necessary for the removal of all purchased item(s) from the building without assistance from City staff. The purchaser is also responsible for restoring the premises to a satisfactory condition, if necessary. The City of Ecorse retains the sole right to judge what is considered to be satisfactory condition of the premises. If the Purchaser shall cause the City of Ecorse to incur ANY expense in restoring the premises to a satisfactory condition in the event of the Purchaser’s default on this obligation, the purchaser will be held solely responsible and liable for these expenses. Mailing/delivery service will not be provided.

PICK-UP TIME LIMIT: If an item is not picked up within 7 business days after the auction expiration date and time, the City of Ecorse reserves the right in its sole discretion to deem item(s) abandon and retain the item(s), to re-list it for auction and block the bidder from future auctions, or to dispose of the item as it deems appropriate.
This was a forfeited vehicle. This vehicle was not used by the City. The City has not driven this vehicle and has not had any maintenance or safety checks performed on this vehicle.
